I do not want to sue the kids, I want to sue the YMCA for not putting the proper fencing up to keep the members from climbing my fence and stomping my plants. They are very aware of this problem and keep promising to fix it, however it just gets worse. They have some 8' to 10' fencing they could put up and they have have said they world at the end of last season. Didn't happen. I am 65 and my husband is 75 and dying of cancer, but we have to put out our SS money to try and have some peace and privacy and we can only do so much on that income. Is there any recourse that can be taken now?

I am sorry for the mess you are going through. I do not believe that you can require a neighbor to put up a fence, though. The Y has their fancy "motto" as you walk in all their doors, one of which, if I remember, is personal responsibility. You might ask for an appointment with the head of the Y and make a personal appearance there to tell them the problem and your plight. At a minimum they can redouble their effort to tell everyone to stay out of your yard.

I don't think that there is a simple fix here.
