green card immigrant education

My son was put in the grade above his age related grade when we moved from England I have been appealing for them to put him in the correct grade for over year. He is failing his courses but the education board will not listen to us. I feel we are being discriminated against on the grounds of our nationality have we no rights?We are legal immigrants with green cards my husband and I both have professional jobs.

No t sure under what law this comes under.

While there may legislation and rules governing the matters of placing pupils in a particular level of educational program, the solution to your problem probably lies in a measured, patient approach with the school's administration. Most would not consider what you describe as discrimination, since it seems your son is being accelerated in his schooling, presumably on the basis of a very good basis he brought with him from his schooling in England. Indeed, school counselors and administrators might well conclude that he is failing his courses for a behavioral or other reason unconnected to his prior schooling and intellectual level. It may be a reaction to his changed environment. Of course, it is always important to know the age and level of the child since so much change occurs in a young person's development over a relatively short period of time.
