Legal Question in International Law in Florida

H-1B Visa, but entering US on B1/B2 Visa Stamp

Dear Sir or Madam,

I entered U.S. on 10 Years Multiple Entry B1/B2 Visa. Before 5 months I changed my Visa to H-1B. My question was:

1. Is my B1/B2 Visa still Valid?, I have the stamp in the passport.

2. If I goto my home country and choose not to get H-1B Stamp on the passport, can I still enter US on the previous B1/B2 Visa stamp.

3. If yes, what will my status be?

4. If my status becomes B1/B2, what are the chances that I can again apply for H-1B visa and get approved ?

Thanks,

Vishal

In order to maintain your H1B status you must apply for a visa stamp at the local consulate, and reenter using such visa. If you do so, chances are that your B1 visa will be canceled upon re-entry. If you do not, you will have abandoned your H1B status and reentered as a B2 Visitor.
