on hire i was awarded 4% of gross proffit each year as an incentive. I negotiated a split between myself and my production mamager 2.5%.1.5%, and was folowed for 3 business years. (My piers were at 4% no split) in the 4th year they changed the disopersion of funds, and while it is still 4% another person is taking his incentive from my share. I have asked to be considered equal to my pier managers, and have been ignored/put off, is performance of a verbal contract evidence that one exists??

You have a contract which because of performance being for a period of a year or more, would need to be in writing in order to be enforceable. An oral contract would not be enforceable.
