Legal Question in Employment Law in Florida

My boss just recently informed us that me and my other 9 associates had to reapply for our jobs...because they are changing our job title and function...and if we do not get the job we are welcome to take a demoted job. Is this legal?

Yes. Unless you have a private contract or are covered by a labor contract, or the company has a policy that prohibits such things. Otherwise, you serve at will, meaning you can quit or be fired with or without cause, as long as it is not discriminatory based on age, race, sex, etc. Bottom line, there is no guarantee of employment absent a contract.

It's not fun, but, assuming you want to stay employed there, I advise that you do everything you can to prepare for the interview, as if it was the first time you were applying to the company, and make yourself as valuable as possible. Learn what the company is trying to accomplish by reorganizing and figure out how you can contribute. Then, even if you don't feel it, project an image of a good team player who understands why the company is doing what it is doing and wants to contribute in the best way possible.

Last, if they only offer you a demotion, you probably should take it. If you refuse work, you might not be eligible for unemployment. Better to stay employed and look for work elsewhere than to be unemployed and not able to pay the bills, even if it hurts your pride.

Good luck.
