Legal Question in Employment Law in Florida

The company has shut down my department and wants to transfer me and all my employees to a separate sister company. Wouldn't they have to terminate us from one company and rehire into the new one? Also, I was given a relocation package that 50% has to be repaid if I leave the company. I am not interested in moving to the sister company because the position isn't what I was hired originally for. Am I still obligated to repay this relo package and/or how do I get out of repaying this?

I dont know that they formally have to terminate and rehire you by the sister company, although I believe that would be the better practice. I think that based upon the transfer, and depending upon the language in your relocation agreement, you might be able to get out of paying back these amounts. You would want a lawyer to review the relocation agreement language. For more information on employee rights check out our blog www.takethisjobnshoveitblog.com or my website www.behrenlaw.com.
