Legal Question in Employment Law in Florida

I have been employed for eight years with the same employer as a recruiter in South FLorida but the owners went through a messy breakup and I was left working for the wife (she was not the person that hired me). Ever since she has been incharge five people have left. I work in a hostile enviornmnet. She always is asking questions I feel uncomfortable with. She has come to the point that she follows her staff to see if they washed their hands. I cannot leave because I have a non compete reason why I need to know if she can ask for doctors notes copy of doctors results and blunt questions like are you pregnant?etc. I feel harrased to a point that I cant sleep knowing I have to go to work for this individual. What can I do?

You would need to meet with a lawyer to discuss whether or not there are actionable claims for harassment or discrimination under Federal or Florida discrimination laws. As to the non-compete, whether it is enforceable or not would depend upon its terms. Perhaps you can find another job and get your current employer to forego the non-compete if you forego bringing legal claims against them. There is also a question of whether or not the non-compete is enforceable if it was signed with the original company you worked for. Feel free to contact me if you wish to discuss these issues further.
