No-compete Clause

When I was hired by my current

company there was a no-compete

clause. It is only one sentence long,

located at the end of a 'Safeguard of

Confidential Information and

Records' page and states: ''In the

event I terminate employment for

any reason, I agree to not compete

with or be employed by, participate

in the management of or own any

financial interest in any business in

competition with (current company)

for a period for one year following

date of termination, within a

reasonable geographic area as

designated by (current company).''

I live in Tennessee and have a job

offer in Florida where my company

has no contracts at the moment.

They did have one contract but lost it

last week. I have only worked with

the company in Tennessee even

though I was hired to work in

Florida- the contract did not go

through and I was sent to Tennessee

and have been here for almost 6

months. If I leave, will my company

be able to prosecute me or enforce

no-compete clause? I was told to

ask a Florida lawyer as the case

might be seen in Florida instead.

I would need to review the non-compete and ask you some questions to analyze whether enforceable. Where is your company based? That would probably dictate where they sue you. Feel free to call or e-mail me with further questions.

Probably not given the geographic location. You might end up needing a lawyer letter to get them to back off if they threaten you or your new employer. Feel free to call my office for a consultation if you need one.
