Legal Question in Employment Law in Florida

non-competion contract

my wife company has just drafted a contracted for all employees to sign. In states that if an employee quits or is fired they can not work in the same work field for 1 yr through out the whole state of florida. my wife has been doing this for over 15 years now. this sounds crazy especially with the way the economy is now. is this een legal, this wsa drafted by supposedly some lawyers.

It depends upon the type of job she is working at. Generally, the geogrpahic socpe must only be reasonable and the entire state of florida may not be enforceable. IF you wish to discuss furhter, feel free to call or e-mail me. Thanks.

Re: non-competion contract

It is perfectly legal to require an employee to sign a non-compete. However, they have to be limited in geography and in scope. The one your wife is asked to sign may be too broad, however, it depends on a variety of circumstances including what type of business she is engaged in, how big the business is, and other factors.

I would be happy to review the non-compete agreement and give you my thoughts. Please feel free to contact me at your convenience.
