Legal Question in Employment Law in Florida

Brent

SECTION IV. NONSOLICITATION; CONFIDENTIALITY

4.2 Injunctive Relief; Remedies.

Employee acknowledges that any breach of the restrictions in Section IV shall

cause irreparable harm and that damages may not provide an adequate remedy. In

the event of a violation and/or breach of any of these restrictions, Employee

agrees that the Company shall, in addition to an award of damages or other form

of relief that may be available to the Company at law or in equity, be entitled

to an injunction enjoining, prohibiting and restraining Employee from the

continuance of any such breach in addition to damages, without the necessity of

posting bond.

It simply means that if you breach the nonsolicitation or confidentiality sections, not only can they get a Judge to enter a judgment for money damages against you, they can also get an Order from the Judge preventing you from continuing the solicitation or breach of confidentiality. Thus, if you continue the behavior, you are in violation of a court order, can be held in contempt, and potentially put in jail.
