Legal Question in Employment Law in Florida

Withholding earn vacation

I live in Green Cove Springs, Florida (about 15miles outside of Jacksonville). My wife worked at Lake Asbury Christian Childcare Center for the past 2 1/2 years. After tireless efforts to bring the center to a acceptable standard, my wife decided to resigned.

My wife is owed two weeks vacation which the employor is now saying that because she didn't give him two weeks notification her two weeks that she earned is fortfied...to the best of my recollection Florida is an at will state which means she actually wasn't required to give a notice. I need some help in recouping the monies that is rightfully owed to her. Please advise.

Re: Withholding earn vacation

Depends on whether the employer has a written policy on unused vacation. Feel free to call or e-mail me to discuss further.

Re: Withholding earn vacation

You are correct. However, an employer is not obligated to give vacation time either. Thus, generally it is a mutual thing absent a written contract or polcies of the company.
