Legal Question in Landlord & Tenant Law in Florida

Evicting Grown Children

What are the steps for a parent to evict non-rent paying grown children?

They were living at my house and have damaged the house. They have never paid rent, but have received mail at my address.

I tried to ''lock them out'' The police informed me that I was not legally allowed to do that. Even though they have never paid rent and are over 21 years of age.

The facts you provided DO NOT provide ALL of the details necessary to FULLY and PROPERLY respond to the question you have posed. You should NOT rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorneys individualized advice for you. By reading the Response below, you AGREE: (i) that the opinion expressed is NOT intended to be legal advice and DOES NOT constitute legal advice to you or any person reviewing such information; and (ii) DOES NOT, create any attorney-client relationship and WILL NOT be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

Reply: You will need to serve them with notice of termination of their lease. The amount of time depends upon the term of the lease. As your fats seem to raise many issues, I suggest that you hire an attorney in your area to serve the notice and then complete the eviction process on your behalf. He can also discuss the liability you may have for the inproper eviction that you did by changing the locks.
