Florida Eviction Laws for Nonpaying ''Tenants''

Over 10 years ago, my father bought a condo for his ex-daughter in law and grandsons to live in. His son had committed suicide, and they were constantly being evicted from apartments and were living on the streets. They were supposed to pay rent to cover the Association fees, but never have. Also, they were only supposed to live there until the boys were not attending school. The boys are now 26 and 21, not going to college. The mother doesn't work; she collects on a W/C injury (back injury - $600) which she claims makes her 'disabled'. We live in California; the condo is in Florida (Ft Lauderdale Lakes). A few months ago my father received a notice from the sheriff's office - the place was sited as a health hazard. He hired a real estate lawyer and agent, and there was garbage, inside and out, piled to the ceiling, rats, cockroaches and holes in the wall. Estimated cost to repair: $20,000. They have been served notice to vacate, and refuse. She responded to the notice to the court stating she is disabled, and was promised free, lifetime living at the condo (lie). She also needs time to secure a lawyer. What are our options at this time? We want them out, so we can sell the condo and be done with this.

I recommend continuing the eviction process. I'd be careful utilizing the health hazard route beceuase your father could be charged with being a slum lord, even though it is of her doing.

Just continue on with the eviction process and then have the sheriff remove her from the premesis.
