Legal Question in Landlord & Tenant Law in Florida

house guest vs. tenant

I let one of my daughter's friends move in with us temporarily. She has been here about a month. We have asked her to find somewhere else to live. Is she considered a tenant or just a house guest

Re: house guest vs. tenant

NOTE: This communication is not intended as and should not be interpreted as legal advice. Rather, it is intended solely as a general discussion of legal principles. You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. By reading the "Response" to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

That is a tough question that has no black and white answer. If she has lived with you without payment of any rent whatsoever, then she may be considered a guest. If she has paid you some form of compensation in return for her stay, then she would probably be considered a tenant. You should meet with an attorney and provide all the facts for a more straightforward answer.
