Legal Question in Landlord & Tenant Law in Florida

A squirrel got into our apartment and ran wild in our bedroom, AND our newborn son's room. Pest control did not find the squirrel but found a point of entry. We do not want to live in a place where wild rodents can attack our son. Can we break the lease without penalty? We live in Tampa, Florida.

No. Plug up the holes, or send your landlord a letter asking him to plug the holes. Any property in Florida can have openings that mice, rats, and roaches can get into. It is your responsibility as parents to keep your home free of pests, and your son safe. Be proactive, don't leave food out on the counter or in the cupboards to attract bugs or animals, look for openings that need to have foam to seal them, etc.

Unless this property has some REAL problem that distinguishes from every other rental property, you need to solve the problem there, not just move to a new one.
