Legal Question in Landlord & Tenant Law in Florida

Tenant Rights During An Apartment Complex Renovation

I am an 8 yr resident in an apt complex being completely renovated. Mgmt said 1- I will have to move to new unit when they are ready to redo my unit (I have a one yr lease) 2- I will have to sign a new lease in new unit even if time is left on my current lease and 3- my rent would not be raised during the renovation (my lease expired during beginning of the renovation and I signed another 1 year lease. Firstly, mgmt DID raise my rent by 5.00 per mth while I am still in my old, badly rundown unit. Secondly, they are advertising and renting to new tenants the newly done units for less than I am paying. I am in dilapidated unit paying 565.00 and brand new tenants in renovated units are moving in and paying 549.00. They are also getting a special where the only thing they pay their first mth in new unit is total of $259.00 (199 special, 10 app, 50 sec dep). Am I entitled to the reduced price of rent they are receiving since I am in same (1 bedroom) apt? Am I entitled to the 1 mth of paying only a total of 259.00 they are getting? And is the apt complex obligated to pay all my moving expenses when they say I have to move to a renovated unit if I still have time left on my lease? And if my current lease is up-who pays for move?

Re: Tenant Rights During An Apartment Complex Renovation

You are subject to all the terms of the lease agreement you signed, and are not entitled to offers for new tenants unless specifically offered to you by the apt complez. With the exception that your rent may be reduced if due to the renovations part of your area is unlivable.

If they are forcing you to move then you will want to ask the apt complex to cover the cost.

You should only be responsible for the remainder of your current lease term and should not be required to extend it, be careful when you renew your lease, read any new leases very thoroughly, they may contain significant changes from your previous leases.

If your lease expired and did not renew, then the apt complex may have no liability to pay for any move to a new apt.
