Legal Question in Legal Ethics in Florida

What liability and responsibility does an attorney have when representing a client by getting payed for a service and then being referred to another attorney it is requested to look at the first attorneys legal actions 5 years later to begin the trail and the attorney response is I don't remember the case and I have any records? Is he liable for malpractice?

Huh? The attorney is contacted 5 years after he is out of the file and he states he has no records and does not remember? No malpractice unless he maintained original papers of the client for which a claim has now been lost due to their destruction. More information is needed to truly assess this question
