Unrefunded Money

How can I collect from someone who installed french doors in my house and was paid $250.00 more than the written estimated price? The quote included two kinds of doors with two totals. We agreed on the lower price, but by mistake I wrote a check for the higher total. When I noticed the error, the check had already been cashed. I contacted the contractor and he promised to look into the matter, but now after numerous calls, he won't even answer his phone. I'm assuming he's screening my calls. I have proof of the invoice with both amounts quoted which he signed as ''paid in full'', and a copy of the cashed check. Is it worth it to pursue this for such a small amount? Is it fair to just let him keep with my money? What is your advice. Thank you for your help.

Small claims court is probably your best option, but you can complain to the BBB and anyone else you find.

It certainly is not fair, but it may not be worth it to bring a small claim action.

You should try writing and perhaps you should go by his office or a place of business and talk to him in person. An in person chat may prey him loose from some money.
