Legal Question in Medical Malpractice in Florida

My son went into the ER with pain in his abdomen, they took an cscan and said it was appendix but they saw a spot on his lungs. For three days after his release I called the doctor with information on his pain and fever and they told me this was normal. This was three years ago. He ended up in the children's hospital with pneumonia and 1500 cc of fluid on his right lung. Is there a statue of limitations on making a case?

See my web site on medical malpractice and Florida Statute 95.11. The problem I see here is how does the scar on the lungs cause the pneumonia 3 years later? Or are you saying the scar was caused by the pnemonia 3 years ago and that is the reason you feel there was negligence? If it is the latter, then the issue is one of damages, even assuming you have negligence. See my web site for a discussion on this. Want to know the law?
