Legal Question in Medical Malpractice in Florida

statute of repose

Unable to secure a malpractice attorney prior to the satute of limitations I am wondering if the statute of repose might be applicable to my case. I was released from the hospital after a bile duct leak, mrsa and kidney failure. No mention of my deteriorating kidneys appeared on my discharge papers. I was released with sepsis, kidney failure, heart, lung and other problems to a rehab facility. It was several months later that I was diagnosed with pulmonary hypertension,COPD and restrictive lung disease. My charts prior to discharge did reveal that my kidneys were failing.

I would like to discuss my case with an aggressive lawyer who will help me seek resolution and punishment to a negligent MD who had no idea how to interput the tests that he ordered. I had all the symptoms of sepsis and it should have been explored as I did get mrsa during surgery.

Thank you,

Michelle

Re: statute of repose

Your question does not indicate any of the relevant dates. If the statute of limitations has expired, I see nothing in your post that would implicate the statute of repose. MRSA is a known complication from surgery and is incredibly difficult to prove that it ocurred because of negligence.
