Legal Question in Personal Injury in Florida

My attorney has a $12,000 hospital lien listed on my settlement proposal sheet. This is a result of a pain management specialist who gave me a shot in my lower back on 2 separate occasions. He has a pain management center in which he gives these shots, but for some reason he chose to have me go to the hospital and let him administer the shots there. I agreed, but when I found out how much it cost me to let him give me the shots at the hospital instead of his place, I was shocked. It cost over $10,000. Plus, the specialist herself has a lien against my settlement for $6,000. My question is am I required to pay a hospital lien that is not recorded at the county courthouse? My settlement is for $65,000 but because my attorney is getting $23,000 and my medical liens total $38,000, that leaves me with less than $5,000. My attorney told me that he will most likely be able to get my liens reduced by $6,000 giving me a total of a little over $11,000.

I very much need to know if I am obligated to pay any liens that are not recorded at the court house. Thanks. I live in Florida...county Walton.

The liens you describe are not recorded at the courthouse, and in most cases you are responsible for satisfying those liens. Your attorney will more than likely work very hard to reduce those liens as low as they can.

The Florida Bar does not look kindly at an attorney who does not pay medical liens. This has always been a major controversy with the Florida Bar and lawyers.
