auto accident

i settled a claim against a drunk driver and im still awaiting my money. the other day i got a subpoena for a restitution hearing against the woman that hit me. it says the state is suing her. will it benefit me in any way?

The criminal restitution would only apply to medical bills, property damage, etc. Not to emotional or speculative damages.

However, it will not award you addittional damages if you have already settled, it will only give you a seperate means of enforcing the settlement agreement.
