Legal Question in Personal Injury in Florida

auto claim

I signed off on the gentlemen Insurance who caused accident for $100,000. this is not nearly enough for my injuries since I have to have another operation. I was a passager in the car and have no car insurance since I do not own an auto. My medical insurance picked up some of my medical. Can I sue the person in a civil court, since he did not fill his affidavate out, and lawyer only did an asset check of home and auto.

Re: auto claim

If you settled with the insurance company, they almost certainly had you sign a release. The release would cover their insured. That is why they paid you. If you released the driver, you cannot sue him.
