Legal Question in Personal Injury in Florida

what do i do now?

i broke my foot at my boyfriends house. the homeowners insurance denied my claim and wont pay. i have a ton of medical bills now. is my next step to sue my boyfriend and have him sue his insurance company? does the insurance company usually get worried when they hear their insured is being sued and offer to pay the settlement? is there a good chance my boyfriend would lose his case against his insurance company and have to pay more money than i ever would have?

Without knowing how the accident happened and what information you gave the insurance carrier

no one can intelligently answer your question.

The insurance company does not get sued directly in a case like this typically. What needs to be done is to bring a lawsuit against your boyfriend, as you suggested, at which time the insurance company has a duty to defend the claim and pay any settlement or judgment which may result on behalf of the defendant (your boyfriend). Feel free to contact me to discuss this at greater length. I regularly handle cases like yours on a contingency which means I charge no up front fee and only collect a fee if I'm successful getting you money.
