Legal Question in Personal Injury in Florida

car accident

My girlfriend was recently in a car accident. One of our law-suit happy acquaintances (Dave) got injured in the back seat. My girlfriend was not at fault but the driver who forced her off the road into traffic fled the scene. So the fault fell on my girlfriend. Her insurance offered Dave 10,000 for personal injury which I believe should more than cover it. He was approached with the offer but he refused. Knowing Dave he is going to try and sue for as much as possible. My girlfriend does not have much savings or assets to go after. However she does have a business. It is an LLC. Can Dave go after the money that is in the business account or is that money protected? What is the best advice you can give to her considering the situation. Thanks

It is very unlikely that he can go after the LLC money unless she was working at the time of the accident, in which case the LLC might have some liability. The insurance company will supply a lawyer if she is sued -- that is what insurance is for.
