Legal Question in Personal Injury in Florida

Not my fault car accident.

My truck was hit by a trailer and the trailer became disconnected from a truck that was towing it. Totalled my truck, left me with injuries, so far ran up $20,000.00 in medical bills. Quit seeing a doctor because no one wants to pay my medical bills. Do I have a right to have my medical bills paid separate from a settlement? What about the loss of my truck, who pays for that? Which to date I have not received any money for. Attorneys fee - do they come off the top of the settlement or would they be taken after all the bills have been paid?

Answer: Only if the person who hit you had MED PAY insurance or under your own insurance. What about the loss of my truck, who pays for that? Answer: You must go against the person who hit you first then if they have no insurance against your own insurance. Attorneys fee - do they come off the top of the settlement or would they be taken after all the bills have been paid? Answer: they come of the top of your personal injury settlment. Most attorney handle the med bills and property damage at no charge.

If the truck/trailer caused your loss, their insurance carrier is responsible, MAYBE! Some insurance policies exclude vehciles pulling a trailer. Your insurance should cover the first $ 10,000 of medical/wage loss. Usually the settlement is the only bite of the apple available, you cannot have your bills paid and also settle. Attorney fees usually are based on the gross settlement.
