Legal Question in Personal Injury in Florida

My friend lives in pompano Beach Florida, Her Son over 18 also stays there and pays for room and board kinda like a roomate. The son was riding a 3 wheeled bicycle on a main street not near the house. The son was hit my another lady not related to the family. The sons attorney is saying since he lives with his mother in her house. by law he has to sue his mother for the accident and not the actual lady that hit him.

Also The sons mother is being told that by law she has to have her son put on her car insurance just because he lives in that house. he does not drive her car.

That sounds odd, but no one can answer this question without knowing more about exactly what happened and whether the person who hit the son was insured. One cannot say for sure what the attorney is referring to without getting some more facts. My guess is that the driver who was at fault has no insurance. This means that the son could make a claim against the uninsured motorist coverage on his mother's auto insurance policy.

It would probably be worthwhile to obtain a second opinion from an attorney in the area who specializes in these types of claims. In particular, he should look for an attorney who is board certified in civil trial law, as the attorneys in our office are.
