my husband has a lawsuit a check was sent to attorney 09/01/2010 but was only in lawyers name they returned it to be recut as two party check how long does that take and can sender backout once a settlement chevk was sent first time?

The new check should hopefully arrive in 10-14 days max, though it is not for certain. If the sender tries to back out of the agreement, you may be able to do a motion to enforce settlement, which if granted, the Judge order the settlement to be enforced.
