insurance company never looked at my totaled vehicle,now they are saying that they are going to take away 20% from my settlement. can they do this?

It is not clear from your post if the settlement is for bodily injury or property damage, and I am not sure what the basis for the 20% reduction is, you did not say. However, the insurance company can offer anything they want, you don't have to accept it. You should know your rights when negotiating with the insurance company.

If the settlement offer is for personal injury then you should consult with a personal injury attorney to advise you of your rights.
