Legal Question in Personal Injury in Florida

I was involved in a motor vehicle crash with someone under the influence in April 2003. She was subsequently convicted of her second DUI offense. Has the statute of limitations for filing a civil suit lapsed?

A person has four years following an accident in which to file a lawsuit. However, if the person injured was under 18 at the time, then the four years begins to run when he or she turns 18. If the person injured was incapacitated in some way, it is possible that the time may be extended in some cases. You need to consult with an attorney in your area to see if you fit within any exception that would extend the statute of limitations beyond the four year period.
