Rights of second wife when husband killed in accident

My husband was hit by a car last week and was killed.since the accident his brother and sisters have told me that my husband never divorced his first wife, and that they didn't tell me while he was alive because they " did'nt want to go behind his back." i do know that my husband had not had contact with first wife for over ten years. am i legally able to seek legal action against the driver who hit my husband, or do i have no rights as a wife if this bigammy accusation proves to be true? i am very confused as to what i should do.any help would be appreciated.

You need to see an attorney who handles wrongful death cases in your local area IMMEDIATELY!!!!! An estate for your husband needs to be created in court, anyone can do that. In order to protect your interest it is best for you to be the person handling that. The estate is the entity that handles any lawsuit against the person causing the death.
