Legal Question in Personal Injury in Florida

Shopping cart broke and my baby fell out

To try and make a long story short, My wife was walking inside save-a-lot supermarket with our 5 month old daughter in her car seat and her carseat was place and hooked onto the shopping cart.When walking in the part of the shopping cart that goes front and back broke and my baby fell into the cart.My baby hit her head but wasn't bleeding or anything (of course crying) The manager at that time refused to come out and speak to her so she had to go next door to use the phone to call the paramedics once they were there the manager then came out asking her to sign a report she was so hurt and upset she refused to sign anything.Paramedics asked to take baby to the ER although there were no signs of serious injury since it was a head injury .Thank god my baby seems to be fine we just need to keep a close eye on her per the doctors.But the way my wife was treated was just disgusting..Any help or advise is appreciated..Thnx Alex

Thankfully, it sounds like your child was not injured. I suspect that the store, if asked, we pay for the medical care. Ask if the have an insurance policy that provides "med pay" coverage -- to which you would be entitled.

It sounds like your child was very fortunate not to have been badly injured. The conduct of the store employee is indefensible, however it doesnt sound like it contributed to any injuries, which is necessary to justify a claim. If there are any medical bills associated with the event you should contact the store and demand payment through the medical payments portion of the store's insurance policy. Good luck.

Sounds like you might have some sort of case against them. Shopping carts shouldn't just break.
