Buying a property with homeowner association

We are planning on buying a townhouse, we were workig out logistics and still had not written out a contract, the realtor just told us that the owners of townhouse owe $5000 in an assessment fee that was charged. The owners say that they are not going to pay the assesment, if we buy it, is it their obligation to pay or ours?

It is negotiable between the parties.

The assessment is normally a charge to the seller. If they do not pay then you will.

If the contract has yet to be written, it is a negotiable item. While it is customary for the Seller to be responsible for previously assessed assessments, it is a matter that should be dealt with in the contract.
