Legal Question in Real Estate Law in Florida

Can co-owner's judgments affect sale?

I own a large piece of property with 6 other people. One of the owners has numerous certified judgements against him. The amount of the judgments may exceed the value of his share.

Will these judgements need to be paid before the property can be sold with a clear title?

Re: Can co-owner's judgments affect sale?

The property may be sold, but it's possible that the closing agent will hold the portion of the proceeds directed to the one judgment debtor in escrow pending resolution of the judgments or, alternatively, send such funds to satisfy one or more of the judgments. The interests of the other owners (non-judgment debtors) should not be affected. There may be other ways to handle this matter, but at a minimum it would require a consultation with an attorney, a review of the final judgments against that one owner and a review of the deed to the property. Good luck.
