duplex

my mother left my brother & i a duplex he lives in one unit and i in the other, would we be co-owners or joint owners. I do not want to be responsible if he does not pay his portion of the property tax or insurance...what would we have o do to make everything seperate? I was already told that the duplex could not be divided into two separate units because there is a dividing wall that is shared.

You would have to file a lawsuit known as a partition. This lawsuit causes the duplex to be sold and the proceeds to be split between you. That may not be what you want, but it's the only why to divide real estate when two or more people own it and can't trust one another or decide what to do with it.

The lawyers are typically paid from the sale.
