Tell the real estate company to interplead the deposit in Small Claims Court. Then, file a Cross-Claim against the Seller demanding return of the deposit. The fees and costs for the real estate company come out of the deposit, so the amount will determine whether it is worth it. An unsigned real estate contract is unenforceable in Florida, pursuant to the Statute of Frauds. Get a consultation with a real estate lawyer for more specific advice.
