Can a home owner of a condominium file a lawsuit against the association for defective construction?

It depends on the nature of the defect. For instance, the association has the duty to repair defects located in the common areas. If the association fails to repair a defect and it causes damage to your unit, then the association would be liable for that damage.

There may be other parties you could sue in addition to the association.
