Legal Question in Real Estate Law in Florida

I leased an apartment, left deposit of $2500. Did not move in but cancelled prior to moving in. Apartment was leased to someone else. Apartment complex charged me a 300.00 cancellation fee plus kept the $2500 as part of their "policy". Do I have any legal remedy?

Whether they were justified in taking your deposit, depends on the terms of your lease agreement with the complex. Check the cancellation/termination provision to see if you agreed to let them keep your deposit and pay a cancellation fee in the event of early termination. If not, then you may consider filing a lawsuit against them in small claims court. Check http://www.800helpfla.com/landlord_text.html
