Legal Question in Real Estate Law in Florida

my neighbors tree fell on my property and caused damage. the weather on that date was excellent,mild,sunny,virtualy no wind(approx 5mph). His insurance wants my insurance to pay.,although the tree was obviously diseased. Also, we have no homeowners insurance due to our house is paid for. This is officcialy my parents home, and my father is deceased and my mom has dementia. We didn't know about the lack of homeowners insurance until recently. What should we do if the neighbors insurance won't help in the repairing of our house?

Unfortunately the only thing you are left with is to file suit against your neighbor. If the tree was on your neighbor's property, they are the owner and have a duty to you if such tree damages your property. Recommend you get 3 bids to repair the home so you know what the damages are worth.
