Private dwelling repairs

Q1: As per the ''Declaration of Condominium,'' replacement of an apartment's damaged windows shall be done at the expense of the Association. Is this correct, and how can I go about demanding it?

Q2: Can an Association request an owner for the first time past due maintenance fees from 2005?
