Legal Question in Real Estate Law in Florida

Property Deed

I'm listed on the deed of a house in Florida and I now reside in PA, have for the past 3 years. My ex fiance wants to remove my name. If I don't remove it, he says I am responsible to reimburse him for taxes paid and also monies spent for home improvements. At the time of purchase his mother, him and myself were on the house. His mother just passed away 3 weeks ago.

Re: Property Deed

You asked about removal from a deed.

Well, the short side is that you will be responsible for taxes and improvements to the home. But, he can and should pay those in full. As long as he keeps track then those amounts can be deducted from the eventual distribution on the sale of the property. Another alternative is that he buys out your portion for a reasonable value. Depending on how the house was titled that may be 1/2 or 1/3 the value of the home. Another alternative is a called a partition where the house is sold according to court order and the proceeds are distributed accordingly. And finally you could simply quit claim your claim to the property, which may be done for any amount or none at all.

It is highly recommended that you get an attorney to review the situation before you make any moves to protect your interests.

Regards,

Roger
