Legal Question in Real Estate Law in Florida

property division in domestic split

Purchased property with another individual and have been

living together since. Because we were planning to marry I signed my full name and partners last name on documents. Marriage didn't happen and split up in the making.

My question is: Do I have legal right to 1/2 of the property if I leave ?

Re: property division in domestic split

Depending on who holds title to the property and who made payments on it, you may be able to recover for or have a right to a portion of the property. To make that determination in Court, you would seek a partition action if you wanted to have it sold or to buy out the other person, but you may have other remedies. Please feel free to give me a call, as I handle cases throughout Miami-Dade, Broward and Palm Beach Counties. 305.357.0296
