I was buying a house in short sale. The seller had his name on the mortgage but his name and another person on the title. On the contract to buy the house he only put his name and never disclosed to me that there was another name on the title. About 10 days before closing we pulled the title and found out. The other party refused to sign the title over to me and the lending bank ended up voiding the contract. I had already paid for inspection, survey and appraisal and am taking him to small claims court to get my money from him. Do I have a case?
