I have a rental property with a tenant that has a expired lease as of last week. They have not paid rent for three months. They are partially moved out, they are still there. We have told them to leave and their taking their time. Do we have a legal right to call the sheriff to remove them today.

No, there is no self help in Florida. If you want to leave your property you must file a formal eviction complaint.

You have legal rights, but you must pursue them through a court eviction proceeding.
