Title transfer

how can a person obtain a title when they cant find the past owner but have documentation to prove agreement and canceled checks as proof of payment

if I understand your question you paid a sum of money which you can prove and it paid off the mortgage on the property. At the conclusion of those payments seller who was excepting this payment structure should have transferred the title to you upon you making the last payment. In order to force this action if you cannot find the person it will require you to file a lawsuit to have the court transfer the property to you. Initially, have your attorney perform a title search to identify all the possible owners/heirs of the seller. Then have the attorney file a quiet title action.
