Can my case manager press for statutory rape against my sons father in florida if i was 16 and he was 21 when i ended up pregnant

In FL, it is not a "statutory rape" crime (sexual battery) for a person UNDER the age of 24 to have consentual sex with a 16 or 17 year old person. See FL Statute 794.05.
