Legal Question in Sexual Harassment in Florida

Stachitory Rape Question

Hi,

Me and my girlfriend recently had sexual intercourse for the first time, and her parents have found out. She is 17 and i'm 18, it was completely mutual but her father is threatening stachitory rape charges of some sort. I was wondering what he would have on me and if i have any major problems i could be facing? She also spent the night at my house, if that changes anything. Thanks.

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorneys individualized advice for you. By reading the Response to your question or comment, you agree that the opinion expressed is not intended to, nor does it, create any attorney-client relationship, nor does it constitute legal advice to any person reviewing such information, nor will it be considered an attorney-client privileged communication. If you do not agree, then stop right here, and do not read any further.

RESPONSE: This has got to be a scary allegation for you, so even though I am not a criminal lawyer, I briefly reviewed flordia jurisprudence, and it looks as though the statutes seem to require "lack of consent" as an element in order to prosecute a case of statutory rape. Good luck and try to work things out with the family,

Randall Gilbert
