Tax not filed

I did my 2002 taxes electronically and it was denied because the lending institution that does the anticipation loans said, I owe money for tax year ''1992'' to another institution and they will continue to process my taxes the regular way and withhold their fee plus the institution they claimed I owe. I called I.R.S. and questioned why my taxes were never sent to H & R Block, and they reply was, ''No Returned Posted for 1992.'' I explained what happened and asked if it was too late for me to submitt the copies of my taxes and was told yes it's too late. I needed to know if I can sue H & R Block for not submitting my taxes and if I can ask for the amount that was owed, fees I paid to them for doing it electronically and legal fees I'll have to pay for.

Until you exhaust your remedies with H&R Block's customer service department, your question is premature. But if you actually filed your 1992 taxes and paid all amounts due for that year, and the present problem stems from an error in the IRS' computer system, this is quite beyond the control of either the bank or the folks at H&R Block, so I doubt that you would have a basis for a legal claim against either of them.

To prevail against H & R, you would have to show your problems are due to negligence or intentional actions of H & R. You may want to seek their help in resolving what seems to be a mess; they don't want unhappy taxpayers/customers. If the fault lies with the IRS, it will be really difficult to resolve the issues or fault.
