Legal Question in Traffic Law in Florida
back seat drinker, no one else in the car is drinking.driver and passenger are completely sober.. Would the driver and passenger both receive a DWI (DUI). What would happen to the back seat drinker.

Only a driver can be guilty of DUI (DRIVING under the influence). The back seat drinker may get an open container citation at worst based on your hypothetical situation...
