Legal Question in Traffic Law in Florida

Car Accident while uninsured

Yesterday I was driving down a main road when a teenage driver pulled in front of me making a right turn at the light causing an accident.

I realize how dangerous driving without insurance is but couldn't afford it along with the costs of my classes.

Instead of an officer coming to the scene, it was a Public Service Aid. She said that since she wasn't an officer she couldn't make the citation. She said that typically she's supposed to call a squad car to come make the citation (an arrest apparently) but if we agreed to handle it between ourselves then we could go.

The father of the girl that pulled out in front of me said he was going to claim it under uninsured motorists coverage if I paid the deductible.

However, my understanding is that if he has it covered by the uninsured motorists coverage, the insurance company will eventually sue for damages anyway.

Do I have any sort of legal defense? Being that besides driving without proper insurance coverage, I did not cause the accident.

Re: Car Accident while uninsured

If it was not your fault for the accident you wont have to pay the damages. In addition, you can recover damages to your vehicle and personal injury regardless whether you have insurance, though you are responsible for what your PIP benefits would have paid.
